Spousal Support / Alimony

In many instances, a spouse can be awarded financial support, either temporary or permanent, as part of divorce proceedings. Spousal support is also known as alimony or more commonly, as maintenance. A number of factors are involved in determining if spousal support applies including:

• The length of the marriage
• Age and health of each spouse
• “Marketable skills” of the supported spouse including the job market for those skills, the time and expense required to obtain appropriate education and training for those skills, needs for re-training or education for new, more marketable skills
• The extent to which one spouse contributed to the other’s educational attainment, training or career position
• The balance between working and taking care of any dependent children from the marriage
• Abilities to pay spousal support including earning capacity, earned and unearned income, assets and standard of living
• Any history of domestic violence between the spouses
